Pocket Bikes
Pocket bikes are all the rage. They look like baby motorcycles, something the Shriners would ride in the Fourth of July parade. These mini-cycles are generally 49cc or less, weigh about 50 pounds, are gas powered, can hold a person weighing up to 250 pounds . They have advertised speeds of 30-40 mph. The basic bikes have just over 4 hp, with some of the more powerful customized ones in excess of 12 hp. They hold about one half of a tank of gas and cost between $300-$500 for the basic bike. But, under the laws of the State of Kansas, are they "street" legal? No, at least not the basic, most popular models.
They do not fit the definition of "motorized bicycle" because they produce more than 3.5 horsepower and most of them have design speeds over 30 mph. They do however fit the definition of "Motorcycle" and "Motor vehicle". Therefore, they must be registered and tagged with the state. You must have a Class M license to operate them; if you are under 18 you must be helmeted, and wear eye protection. As motorcycles, they cannot be driven on sidewalks or bicycle trails. You must carry insurance and they must have the necessary equipment of all motorcycles. This last requirement is the kicker. They generally lack appropriate turn signals, mufflers, headlights at a certain height, and other items necessary to operate on public streets.

that govern the operation of motorized scooters and pocket bikes vary from state to
state. In addition, enforcement may vary from city to city. Before you make a
purchase, we recommend that you contact your local law enforcement agency, DMV
and insurance carrier to obtain the most up to date and accurate information for
your area.
